Overview of the
Office of The Speaker

Democracy demands that processes and procedures are established which ensures that respect for debate and criticism is possible and encouraged. This means that it must be possible for the position of the majority party to be challenged and critiqued.

With this understanding the key role and responsibility of the Speaker is to ensure the integrity, independence and impartiality of the institution.

The Speaker is elected by the House and becomes the Chairperson of Council and is therefore the chief custodian and guardian of the legislative arm of Council.

The Office of the Speaker assists the Speaker in executing his or her function, and is therefore, the primary administrative support department for the legislative arm of the council.

Role of the Speaker:

  • Presides over Council meetings
  • Ensures Council meets at least every quarter
  • Building democracy

Chairing of Meetings
The Speaker is the Chairperson of the Rules Committee and other political management structure

Responsibilities

  • Presiding over house sittings and fairness of debates in the House
  • Protecting the rights and privileges of the House
  • Preserving the Independence of the House
  • Interpreting and enforcing standing orders (ensuring rules of Council procedure are applied)
  • Exercising disciplinary power as to maintain order during debate
  • Making statements or announcements to the house
  • Carrying out functions impartially
  • To assess the needs of Councillors, arrange suitable training to develop political governance capacity and improve individual skills
  • Manages community participation particularly through the ward committees
  • To ensure public consultation, involvement and participation in the affairs of the municipality

STANDING COMMITTEES (SCs)
These committees are permanent committees established to deal with Council matters. They are delegated some decision making powers and are required to submit reports to Council. There are currently four (4) SCs at MCLM. They are:
The Rules Committee:
Role:
  • Developing and approving rules for the Council proceedings
  • Determining focus areas in respect of capacitating Councillors

The Ethics/Disciplinary Committee
  • Ensuring declarations of financial interest and compilation of the Register of Financial Interest on an annual basis
  • Considering any alleged breaches of the Code of Conduct by Councillors

The Municipal Public Accounts Committee:

  • Exercises oversight over the management and expenditure of Public money
  • Council has to be able to provide assurance to the public that public money and assets are being managed properly and that value for money is being rendered by public sector institutions in their spending of public funds
  • Enables Council in respect of financial management to fulfil its constitutional obligation to scrutinise and oversee executive action in a non partisan fashion
  • Holding the Accounting Officer (Municipal Manager) and Councillors accountable for their spending of ratepayers’ money and their stewardship over public assets
  • Follows up on the AG’s reports

The Petitions Committee:
Role:

  • Ensuring proper and timeous responses to petitions directed to MCLM’s departments
  • Instruct the administrative support service to inform a petitioner timeously
  • Make recommendations

Complaints Form:
This form is to be filled in by residents who have exhausted internal processes of raising general complaints about council services. The form must be filled in and sent with supporting documentation to: Office of the Speaker, PO Box 94, Krugersdorp, 1740. Alternatively, you can email the form to  speaker@mogalecity.gov.za.
